COLDWATER (WKZO) -- Branch County prosecutors have begun presenting their case against accused murderer Tom Foley again, calling the detectives and officers who investigated the crime. 

Thursday, they heard from Toby Marshall, who took his K-9 into the home to find weapons and ammunition, but missed the bag that contained shotgun shells in the basement.  It would later be found by detectives.

Foley has always claimed he is innocent.   The defense says that the victim, Dee Dee Foley, must have surprised a burglar, who killed her with a shotgun.  The prosecution claims that Foley killed her and trashed the home to make it look like it was burglarized, but the shotgun and the stolen items have never been found.

Since his conviction, additional witnesses have stepped forward to say they saw a strange car parked on the house, or racing from the scene on the day Mrs. Foley was killed.  It was the appearance of those witnesses that prompted the judge to order a new trial.  

Those witnesses will be called when the defense begins its case, probably next week.
